Contractor Breach of Contract Overview
Contractors engaged in construction in California have a duty to adhere to a
variety of professional and industry standards, including those provided by their written agreements, the contractor provisions of Business & Professions Code, building codes, laws, the approved architectural and structural plans, and, where applicable, the building standards for original construction found in California Civil Code § 896. Warranties both express and implied exist as well, and undoubtedly issues related to the representations made when the contract was formed and during performance are also critical.
A failure to comply with any of these standards may give rise to a claim against
the contractor for damages. Contractor disputes often include delay claims and disputes over change orders and additional charges that arise during performance. Contractor misrepresentations give rise to claims for fraud and negligent misrepresentation. An understanding of contractor duties and their liability, the range of damages available and contractor/subcontractor insurance policy coverage is essential to evaluating and successfully prosecuting these claims.

When to Make a Claim
There are a number of overlapping statutes of limitation that apply to claims against contractors, including the 4-year period for breach of contract, CCP § 337(a), 3- year period for damages to real property and fraud, CCP § 338 and § 338(d). Other statutes and factors apply, including the discovery rule, so it’s important to consult with an attorney immediately upon becoming aware that you may have damages or a claim.
