California Architects have a range of duties under the California Architect’s Board
Rules of Professional Conduct and have a duty to comply with all applicable building
codes, laws and regulations, and in new residential construction, the building standards
of the Right to Repair Act, California Civil Code, Title 7, CCP § 896, and as well as
common law duties to third parties, including possibly, future homeowners and
subsequent purchasers. These standards are particularly important where the architect
is engaged in construction and contract management in addition to design. Design
defects or any breach of any of these duties may give rise to claims for damage for
violation of professional standards, building standards, breach of contract and common
law claims, including negligence, and possibly, fraud and negligent misrepresentation.

The two-year statute of limitations found in CCP § 339 (1) applies to actions
against architects for professional negligence. It is important to consult with an attorney
